Definitions & Terms Used

“Accommodation and Food & Beverage” means principally hotel accommodation and meals and/or bar expenses (if applicable) provided by the Hotel which Customers may redeem using their Gift voucher dollars.

“Purchaser” means a customer that orders and purchases a Chateau Yering Hotel Gift voucher from the Promoter pursuant to the Program on behalf of a Customer

“Customer” means a customer who has been issued with a Chateau Yering Hotel Gift voucher by either the Promoter (CHATEAU YERING HOTEL MANAGEMENT PTY LTD) or Purchaser pursuant to the Program and is the specified holder of the Chateau Yering Hotel Gift voucher.

“Gift Dollars” means the pre-determined nominated dollar value which is pre-loaded in  Australian Dollars on to the Chateau Yering Gift voucher at the time of issue. The amount pre-loaded is advised to the purchaser and the recipient is advised of the inclusions of the package or amount if specified. The gift voucher is to be treated with the same care and security as cash. If lost or stolen, Chateau Yering Gift vouchers cannot be replaced. Unless approved by management and the identity is proven.

The gift voucher remains the property of the promoter.

1 Use of Chateau Yering Hotel Gift Voucher

1.a The Chateau Yering Gift Voucher is used primarily to redeem “Gift Dollars” towards Accommodation and Food & Beverage products at Chateau Yering Hotel. Customers may make an accommodation reservation at Chateau Yering Hotel by calling the hotel directly. All accommodation reservations require a valid gift voucher to guarantee & confirm the reservation. Upon check-in the Customer should present the original Gift voucher and inform staff if they wish to redeem the Gift Dollars in exchange for Accommodation and or Food & Beverage. Upon check-out the credit card advice which is collected on check in will be destroyed if the Customer has finalised the final account utilising the Gift Dollars stored on the their Chateau Yering Gift voucher and payment made for any additional incidentals consumed whilst staying at Chateau Yering Hotel.

Chateau Yering Gift Vouchers are sold as Accommodation package, Dining packages, High teas or specified dollars denominations. They can be used for redemption in local currency only.

1.b Copies of Chateau Yering Hotel Gift Voucher will not be accepted. Chateau Yering Hotel Gift vouchers will be deemed void if altered in any way.

1.c Chateau Yering Hotel Gift Voucher Dollars can be used to redeem Accommodation and Food & Beverage, meals, room service and other services in local currency that can be charged to a guest account at Chateau Yering Hotel. Any other travel costs and expenses incurred are the sole responsibility of the Customer.

1.d Customer can redeem for Accommodation and Food & Beverage from multiple (two or more) Chateau Yering Gift voucher’s at the same time, if provided at the time of check – in and advised at the time of making the reservation.

1.e Reservations at Chateau Yering Hotel remain subject to availability at the time of booking. No guarantee can be given that a particular room will be available at the Hotel for the day or for the days that the individual Customer may prefer.

1.f Customers can cancel a reservation or make a date change; however they must do so by contacting the hotel directly and advising them of the cancellation or date change abiding also by our cancellation policies. If the Customer fails to advise about cancellation or no show in guidance to our cancellation policy before the scheduled date of arrival at Chateau Yering Hotel, pursuant to the reservation, a cancellation fee, in lieu one night’s accommodation at the reservation rate will be charged and voucher will become void.

1.g Chateau Yering Hotel Gift Vouchers cannot be bought & re-sold by via 3rd party auction sites. Any Chateau Yering Hotel Gift Vouchers found for sale on such sites will be deemed null and void and electronically cancelled

2 Purchase & Payment of Chateau Yering Hotel gift vouchers

2.a Purchase of a Chateau Yering Gift Voucher’s can be made online at www.chateauyering.com.au or via phone call to reservations. Online or phone orders must be purchased using a valid credit card.

2.b Chateau Yering Gift Vouchers are dispatched when full payment (of the amount equating to the number of Gift Dollars pre-loaded on the voucher, in each case) is received by the Promoter (including any service or postage charges) in accordance with these Terms and Conditions. Refunds and exchanges are not available after full payment is received, unless approved by management.

2.c Orders are dispatched within 5 business days of receipt of the order and payment in full. Currently accepted credit cards include Visa, MasterCard American Express & Diners Club. American Express & Diners Club do incur a surcharge. Direct credit option is available as mentioned will not be processed unless payment has been cleared and funds are received.

2.d Chateau Yering Hotel gift vouchers are issued in Australian Dollars only.

2.e All prices are inclusive of GST unless otherwise stated. Any other taxes, charges, fees or duties that are, or may be levied on such prices or Accommodation and Food & Beverage must be paid for by the Purchaser unless otherwise stated.

2.f Should the gift voucher not be an accommodation package and or large domination and is required to be express postage it is at the purchaser’s expense.

2.g The Promoter is not responsible for inaccurate or incorrect information supplied during the ordering process, either caused by Customer or Purchaser or by any of the related Information Technology infrastructure/platform nor programming associated with or used in this hotel, or by any technical error that may occur in the course of the administration of this. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of orders and/or other information submitted in connection with this purchase.

3 Delivery of Chateau Yering Hotel gift vouchers

3.a Chateau Yering Hotel gift vouchers will be delivered by post or can be collected when ordered via www.chateauyering.com.au or over the phone. The Promoter will not be held liable for any loss as a result of Chateau Yering Hotel gift vouchers being lost, stolen or damaged once dispatched for delivery.

3.b The Purchaser is solely responsible for correctly informing the Promoter of their contact details and address(es) to allow for timely delivery of the Chateau Yering Gift vouchers’. Changes to orders can only be accepted in writing via email to info@chateauyering.com.au. No changes made via telephone will be accepted, unless accepted by management.

4 Expiry Date of gift vouchers

4.a All Chateau Yering Hotel gift vouchers are valid for 3 years from the date of issue (“Validity Period”).

4.b If the Customer does not fully redeem all of the Gift Dollars on the Chateau Yering Hotel gift Voucher for  Accommodation and Food & Beverage within the Validity Period, they may apply for an extension of the Validity Period by making written application to info@chateauyering.com.au or calling reservations no later than 1 month prior to the expiry of the Validity Period as indicated upon the Chateau Yering Hotel gift voucher.

Application for extensions must clearly contain the following information:

(i) why an extension to the Chateau Yering Hotel gift voucher  is being required
(ii) the Chateau Yering Hotel gift voucher number and
(iii) the expiry date of the Chateau Yering Hotel gift voucher.

The Promoter reserves the right to grant a Customer an extension of the Validity Period at its absolute discretion but is not bound to do.

5 Stolen or Lost Cards

5.a In the event of a Chateau Yering Gift voucher being lost or stolen a Customer is not entitled to a cash refund of any unused ‘Gift Dollars’. They should contact the Chateau Yering Hotel Manager at info@chateauyering.com.au.

5.b The Promoter will not accept any responsibility for stolen, lost, damaged or wilfully defaced Chateau Yering Hotel Gift vouchers or for any un-authorised or fraudulent use thereof.

6 Liability

6.a To the extent permitted by law, the Promoter, its authorised agents make no representations, warranties or conditions of any kind, express or implied with respect to the Chateau Yering Hotel gift voucher. The Promoter does not represent or warrant that a Chateau Yering Hotel gift voucher will always be accessible or accepted.

To the extent permitted by law, in the event that the Promoter, its authorised agents are found liable to the Purchaser or Customer, they shall only be entitled to recover actual and direct damages and such damages shall not exceed the last balance held on that Customers Chateau Yering Hotel gift voucher.

The Promoter, its authorised agents shall have no liability for any incidental, indirect or consequential damages arising out of or in any way connected with the use of a Chateau Yering Hotel gift voucher.

Certain legislation, including the Trade Practices Act 1974 (Cth), may imply warranties or conditions or impose obligations upon the Manager, the Service Providers and the Attractions which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. This agreement must be read subject to these statutory provisions.

If these statutory provisions apply, to the extent to which the Promoter, its authorised agents are able to do so, their liability under those provisions will be limited, at their option to:

(i) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods; the payment of the costs of replacing the goods or of acquiring equivalent goods; or the payment of having the goods repaired; or
(ii) in the case of services, the supplying of the services again; or the payment of having the services supplied again.

7 Dispute

7.a In the event of any dispute or issue arising in regards to the Chateau Yering Hotel gift voucher or any Accommodation and Food & Beverage purchased with the Chateau Yering Hotel gift voucher, or any other dispute in relation to any matter concerning the conduct or administration of the Program, the Promoter may authorise the Chateau Yering Hotel Manager to consult with the Customer or Purchaser (as the case may be) in order to resolve the dispute or issue, but this does not create an obligation on the Promoter to do so.

7.b Any and all decisions of the Promoter in relation to any aspect of this gift voucher will be final and binding on the Customer and Purchaser.

8 Acceptance of Terms

8.a The submission or electronic receipt of an order is deemed to constitute acceptance of these Terms and Conditions.

9 Right to Modify, Alter and Amend

9.a These Terms and Conditions are subject to the specific terms and conditions of the Chateau Yering  Hotel.

9.b The Promoter reserves the right to modify, change and alter any Terms and Conditions in its absolute discretion at any time without notice and without liability. The Promoter also reserves the right to terminate the Program in whole or in part in its absolute discretion at any time without notice and without liability. Any and all ‘live’ Chateau Yering Hotel gift vouchers within the marketplace will be honoured until the end of their Validity Period (6 months of the gift voucher being issued).

10 Permission

10.a In line with Chateau Yering Hotel Privacy Policy, the Promoter may retain information provided in connection with the purchase. Details about Privacy Policy and how such information is treated can be found on our website www.chateauyering.com.au.
